The Prime Minister has just assigned the Ministry of Transport to assume the prime responsibility for reviewing and proposing policies and solutions to support various types of transport that are falling into tragedy when they are continuously affected by four waves of Covid-19 epidemic. 19
As an enterprise (DN) with nearly 100 passenger cars, Mr. Do Van Bang, Director of Minh Thanh Phat Trading and Service Co., Ltd (Star Viet garage running the Lao Cai – Hanoi route), said from the beginning of the year. From 2021 to now, the enterprise is almost “clinically dead” when there are only 5 cars left. Businesses are struggling but still have to keep employees, if they let them rest, it will be difficult to recruit them when they resume operations.

Close to the limit of insolvency According to the director of Sao Viet car company, production and business revenue is almost zero, but every day still has to bear countless expenses such as bank interest; rent for factories, warehouses, salaries to support officials, employees, drivers; road maintenance fees … A series of passenger transport enterprises are in the “swallowing” scene. “Before the epidemic, on average, each month we spent about 3 billion dong on salaries and bonuses for drivers and employees. However, today, even though there is no revenue, we still have to “burden” nearly 1 billion dong/month “- Mr. Bang stated. Not only road transport, the air transport market has suffered the most severe decline ever, prompting the Ministry of Planning and Investment to issue a warning that the solvency of enterprises is declining close to the limit of insolvency. maths. For example, the national airline of Vietnam (Vietnam Airlines), it is expected that the loss of the first quarter of 2021 will be at VND 4,800 billion and in the first six months of the year may reach VND 10,000 billion. Currently, the amount of overdue debt has reached VND 6,240 billion and is in a very difficult situation. Vietnam Airlines has more than 9,000 employees who are on unpaid leave and temporary suspension of labor contracts. Most transport businesses are facing great difficulties due to the Covid-19 epidemic Vietnam Railways Corporation (VNR) also lost 50% of passenger transport revenue in the past 5 months due to people restricting travel, the railway industry had to cut many passenger trains. Mr. Nguyen Cong Hung, Chairman of the Hanoi Taxi Association, said that the number of passengers decreased by 80%-90%, revenue fell seriously, and workers’ lives were difficult. A series of taxi companies are facing the risk of bankruptcy, and bad debts are at high risk of increasing in the banking system. Therefore, recently, the Taxi Associations of Hanoi, Da Nang and Ho Chi Minh City have jointly signed a document to send to the Prime Minister, proposing to support taxi transport enterprises to overcome difficulties before the Covid-19 pandemic. Proposing many solutions Facing the above situation, the Prime Minister has just assigned the Ministry of Transport to consider and propose policies and solutions to support passenger transport enterprises facing difficulties due to the Covid-19 epidemic. to border gates and between regions in the domestic market. According to Mr. Tran Bao Ngoc, Director of the Transport Department (Ministry of Transport), since the outbreak of the epidemic, the Ministry of Transport has proposed policies and solutions to support transport enterprises in difficulty. Regarding the solution to remove the vehicle inspection cycle, Mr. Ngoc said that the Ministry of Transport is amending Circular No. 70/2015 in the direction of adjusting the inspection cycle of passenger cars of all kinds up to 9 seats with transportation business. , adjusted from 18 months to 24 months for the first cycle and from 6 to 12 months for the recurring cycle. In addition, the Ministry of Transport also proposed that the Government delay the time of sanctioning transport enterprises that do not install surveillance cameras due to the impact of the Covid-19 epidemic. Regarding the proposal to exempt road maintenance fees until the end of this year, Mr. Ngoc said that in order to remove difficulties for those affected by the Covid-19 epidemic, Circular 112/2020 of the Ministry of Finance allows to reduce collect road user fees from January 1 to June 30, 2021. “The Ministry of Transport has proposed to the Government to reduce value-added tax to 0%, reduce 50% of corporate income tax for industries seriously damaged by the epidemic. Besides, delay payment of tax amount for 6 months for 6 months. arrears until December 31, 2021 and there is no fee for parking, parking and picking up passengers at the airport, train station, port and 50% discount on service prices through the bus station for passenger cars. sign for new registered vehicles for transport business until December 31,” said Mr. Ngoc. It is still difficult to access support policies As a large passenger transport enterprise in Quang Ninh province, Mr. Doan The Xuyen, director of Phuc Xuyen Co., Ltd., said that the company has over 300 vehicles that have stopped working but still have not been exempted from road maintenance fees because of cumbersome procedures. . For example, to be exempted under the regulations of the Ministry of Finance, the vehicle must stop working for 30 days or more, then return the badge and be certified by the Department of Transport. “You can stop for less than 30 days to be able to run again, then you have to apply for a new badge. Many businesses still have to pay even though the car is not running because they are afraid of procedures,” said Xuyen.

(Photo: Hoang Hung/VNA) In the written response to the Vietnam Automobile Transport Association and the three-region taxi association, the Ministry of Transport agreed to allow car inspection cycle will increase from 18 months to 24 months to remove difficulties for transport businesses affected by the COVID-19 epidemic. Currently, the Ministry of Transport is directing agencies and units to advise on finalizing the draft Circular amending Circular No. 70/2015 regulating the inspection of technical safety and environmental protection of vehicles. road motorized traffic. “The inspection cycle of passenger cars of all kinds up to 9 seats with transportation business will be adjusted from 18 months to 24 months for the first cycle and from 6 to 12 months for the periodic cycle,” said the leader. The Ministry of Transport said. For the proposal to have appropriate policies and mechanisms for BOT investors to reduce road use fees according to Circular No. 112/2020 of the Ministry of Finance, the Ministry of Transport said Circular No. 112/2020. of the Ministry of Finance stipulating the rate of road use fee (toll collected per vehicle) for automobiles doing transport business of transport enterprises, transport business cooperatives, and transport business households. “The collection of road service fees is not specified in Circular No. 112/2020, so investors do not have to follow the guidance of this Circular,” the leader of the Ministry of Transport affirmed. . On the other hand, a number of investment projects in the form of public-private partnerships managed by the Ministry of Transport have reduced road user service fees; BOT projects have not been considered to increase road use prices, although it is time to increase prices in the last 3 years in order to share and harmonize the interests of the State-people-enterprises. Moreover, BOT investors are also businesses and are also affected by COVID-19 epidemic due to the reduction of vehicle traffic through the station, revenue will be reduced, affecting the financial balance of the enterprise; increase in interest expense and operating expenses of the business. Regarding the proposal for exemption from submission road maintenance fees By the end of this year, according to leaders of the Ministry of Transport, this agency is coordinating with the Ministry of Finance to comment on amendments to Circular 112/2020 and related circulars to assist in removing difficulties for production and business in response to the COVID-19 epidemic chaired by the Ministry of Finance.

The policy on excise tax and registration fee is being considered by the Ministry of Finance, and is expected to be submitted to the Government and the National Assembly to amend a number of contents to encourage production and consumers to use electric cars.

VinFast is building electric car charging stations The Ministry of Finance has just sent a document to the Ministry of Industry and Trade, the Ministry of Justice, the Ministry of Natural Resources and Environment and the Ministry of Transport, to respond to tax incentives for battery electric cars. Proposals for tax incentives only mention battery electric vehicles (BEVs). Currently, according to statistics, battery electric vehicles account for about 1% of electrified vehicles in Vietnam. Electric vehicles include many types of vehicles. In addition to gasoline-powered vehicles combined with electric energy (including HEV, PHEV) and Hydrogen-fueled cars (FCEV), there are currently BEV (pure electric) battery electric cars. Completely electrically charged from an external source. The two types of hybrid vehicles move mainly with internal combustion engines, in parallel taking advantage of the benefits of an electric powertrain consisting of an electric motor with a battery. FCEVs have an advantage over BEVs when the charging time is short, but the production of water makes hydrogen fuel-powered electric vehicles only suitable for island nations, arid areas, and unsuitable for urban areas. big. Meanwhile, BEV battery electric vehicles have a minimalist structure, run short distances, can consume electricity everywhere, have great advantages in urban areas. With three types of vehicles HEV, PHEV and FCEV all use gasoline and gas, so they have more impact on the environment than BEV models. Electric cars are becoming an advantageous choice to replace vehicles using internal combustion engines, especially battery electric cars (BEVs). Many countries around the world have had preferential policies and tax support to prioritize the development and production of battery electric vehicles. According to the Ministry of Finance, Vietnam has a number of preferential policies for electric vehicles. Accordingly, electric cars carrying passengers with less than 9 seats are entitled to the special consumption tax rate of 15% (ie 10% reduction compared to cars of the same type using fossil fuels; 10-16 seats are allowed to be used for cars of the same type using fossil fuels. tax rate of 10% (5% reduction compared to cars of the same type running on gasoline) and the tax rate of 16 to less than 24 seats is applied at the tax rate of 5% (5% reduction compared to cars of the same type running on petrol). At the same time, the Law on Special Consumption Tax No. 27/2008/QH12 also stipulates the special consumption tax rate for environmentally friendly vehicles. Specifically, vehicles running on gasoline combined with electric energy and bioenergy, in which the proportion of gasoline used does not exceed 70% of the energy used by the vehicle, is entitled to a tax rate of 70% for vehicles of the same capacity. species. For cars running on bio-energy, the special consumption tax rate is only 50% compared to cars of the same type. Meanwhile, about the current registration fee, there are only preferential rates for buses using clean energy while there is no policy applicable to other environmentally friendly vehicles. To encourage production and stimulate consumers to use BEVs, contributing to reducing the emissions released into the environment by vehicles, contributing to the protection of the ecological environment and based on the outstanding advantages of vehicles. BEV, the Ministry of Finance is planning to propose new incentives for this model. An electric vehicle charging station in Ho Chi Minh City Specifically, incentives related to excise tax fall under the jurisdiction of the National Assembly. Therefore, the National Assembly must amend the excise tax law. The Government has also assigned the Ministry of Finance to preside over the overall assessment of the implementation of the excise tax policy on automobiles in the past time to study and amend the excise tax law accordingly. Regarding the registration fee under the authority of the Government, when there is a need to change, it will amend and supplement Decree No. 14/20216/ND-CP on registration fee. The Ministry of Finance said that in the past time, it has also received recommendations from a number of associations on adjusting registration fee rates to remove difficulties for businesses. Therefore, the Ministry of Finance is also evaluating the overall policy on registration fees and is expected to submit it to the Government in October. The Ministry of Finance also asked agencies to propose specific content on special consumption tax incentives and registration fees related to battery electric vehicles to summarize and report to the Government. Battery-powered electric vehicles currently account for a very small percentage in Vietnam. According to data from the Vietnam Automobile Manufacturers Association (VAMA), the number of electrified vehicles registered in Vietnam is still very modest, accumulating just over 1,000 units by the end of 2020. of which BEVs only account for about 1%, the rest are HEV and PHEV models. According to the Ministry of Finance, currently only VinFast invests in producing electric vehicles, according to reports, VinFast has now launched the first battery-powered electric car model. The factory has a capacity of 250,000 vehicles per year and the brand is focusing on battery electric vehicles with 9 seats or less and electric buses with 24 seats or more. Also according to the Ministry of Finance’s assessment, the biggest obstacle facing Vietnam today is the lack of charging station infrastructure, the main source of power for power supply is using fuel sources with high CO2 emissions, accounting for nearly half of the total mobilized electricity output, while the electricity generated from renewable energy accounts for a small proportion, about 4.3% and this is considered an unstable power source.

Despite applying the new emission standards, cars manufactured from 1999 to 2008 still meet the required emission standards.
According to the Prime Minister’s Decision No. 16/2019 on the roadmap for the application of emission standards for cars in traffic and imported used cars, from January 1, 2021, the standard will officially apply. Level 2 emissions for vehicles manufactured from 1999 to 2008. However, according to a survey of PV, despite having to meet the new emission standards, most of the old cars pass the classification. this part.

Roadmap well prepared According to the registry centers in Ho Chi Minh City, the number of cars produced from 1999 to 2008 failed to register much. One of the reasons is due to the pre-existing registration roadmap, so people are aware of car maintenance and care during use. In addition, cars currently operating on the streets in Vietnam are not large and instead of using 10-20 years as before, car owners only use about 5-10 years to have the need to change new cars. . Mr. Tran Van Chu, branch director of the 5003V Registry Center, said that people had prepared and cared for cars in advance, so the fact that the car produced from 1999 to 2008 applies level 2 emission standards. it was too sudden for them to panic or worry. On a professional perspective, the director of another center shared that nowadays people also ride a lot of new cars, so the new emission standards are being met. According to this position, the good is not 100% of the cars are qualified, but with the current threshold, most cars do. In particular, the care and maintenance is one of the issues that greatly affects the emission standards. This director analyzed further, it is possible to compare emissions like using the stove for cooking, if you want to smoke out well, you must have a good source of ingredients. If wet firewood is used, the haze of the sky, likewise, poorly maintained engine and exhaust, not changing filters, or not cleaning the exhaust pipes will affect the exhaust gas. “As for a diesel engine, it doesn’t matter how to burn it, but being sprayed with black smoke is not good. Sometimes the exhaust or exhaust is clean, but the engine’s source (gasoline, oil) is not up to quality, ”- emphasized this taste. According to the Vietnam Registry Department, gasoline-powered vehicles from 1999 to 2008 accounted for 5.5% of the total number of sleds registered. Photo: THY NHUNG Tighten the emission test to protect the environment According to data provided by the Vietnam Registry Department, the number of vehicles produced from 1999 to 2008 failed to register too much. Specifically, from the beginning of 2021 to the end of April 19, for gasoline-powered vehicles, there were 13,121 sleds out of a total of 541,390 vehicles registered. Particularly, this type of vehicle has a production life from 1999 to 2008, accounting for 5.5% of the total number of registered sleds. As for diesel-powered vehicles, there are 36,278 sleds out of a total of 460,878 registered vehicles. Likewise, the number of cars produced between 1999 and 2008 also accounts for 12.7% of the total number of sleds registered. According to the Registry Department, the inspection of emissions in the automobile inspection started in 1999 in Vietnam. Currently, regulations on emission standards and emission measurement procedures for automobiles are regulated in Decision No. 16/2019 of the Prime Minister and National Standard TCVN 6438: 2018. . Accordingly, any vehicle may not meet the regulations on emissions in the technical safety inspection and environmental protection of motor vehicles in traffic if the vehicle is not inspected and maintained. regularly according to the manufacturer’s instructions and regulations. “The application of the new emission standard is part of the roadmap to raise the emission standards and tighten the inspection process for motor vehicles in Vietnam. Accordingly, this will contribute to reducing environmental pollution caused by transportation, contributing to creating a better living environment, protecting the environment, and protecting people’s health ”- Mr. Dang Tran Khanh , Deputy Head of Motor Vehicle Inspection Department, Vietnam Registry Department, said. According to Mr. Khanh, people should check and maintain their cars regularly, in accordance with the regulations and instructions of the manufacturer and before going to the inspection. In addition, it is also important to use a vehicle that conforms to its design specifications, without overloading the design load. From 2022, cars must meet 5 emissions standards Circular 06/2021 of the Ministry of Transport promulgating national technical regulations on level 5 emissions for new manufactured, assembled and imported cars takes effect from January 1, 2022. This Technical Specification specifies emission limits, tests and test methods, requirements for the management and organization of level 5 emissions checks in quality control, technical safety and protection. production and assembly automobile environment and new imported cars. Accordingly, the types of cars applied in this regulation include cars with at least four wheels, classified as low-standard-volume cars and high-standard-volume cars (explained in the circular. ). Tricycles with a self weight greater than 400 kg (considered cars according to TCVN 6211: 2003) are tested for exhaust gas according to QCVN 04: 2009 and QCVN 77: 2014. This Regulation does not apply to the following types of cars: Cars designed and manufactured to run on all types of terrain and roads that do not belong to the road traffic system; electric cars (cars that use electricity only as the driving force).

Prime Minister Pham Minh Chinh presided over the meeting with leaders of the Ministry of Transport. Grasp the principle of “3 no” The Prime Minister stated that when removing difficulties and problems for localities, it is necessary to grasp the principle of “3 no”: Do not say no, do not say it is difficult and do not say yes but no. The functions, tasks and jobs of the industry are very heavy and difficult. Therefore, in order to fulfill their tasks well, officials and leaders need to thoroughly grasp the spirit of “think ripe, must be careful; thought must be informed; determination must be high; the effort must be great; the action must be drastic and effective; do focus, key; Whatever you do, you will finish it ”. The Prime Minister also asked the Ministry of Transport to attach importance to Party building, improving leadership capacity and fighting strength of each party organization, party members, building a clean, strong and comprehensive Party Committee of the Ministry of Transport. Increase decentralization and decentralization go hand in hand with control, supervision and power control. As the agency managing the facilities with large capital, the Ministry of Transport must take the lead in the prevention of corruption, negative, wastefulness, bureaucracy, from ministry leaders to cadres, civil servants and public employees. set, more powerful and efficient. In order to do so, it is necessary to firmly grasp 5 basic principles in the organization and operation of the Party, 5 modes of leadership of the Party and apply creatively in the specific conditions of the Ministry, especially to strictly observe the principle of concentration. democracy, operating within the framework of the Constitution and the law. Emphasizing the promotion of good lessons learned, the Prime Minister said that it is necessary to summarize the practice, replicate good models and effective methods in the transport industry as well as the whole country. “Sticking to reality to adjust, respect reality, derive from reality, take reality as a measure”. Focus resources for implementing key and key projects The Prime Minister asked the Party Committee and Ministry leaders to pay more attention to cadres work, streamline organizational structure, effective and efficient operation and personalize personal responsibilities, benefit the interests of the nation, the nation and the people come first. Along with that is building a clean and strong staff. Staff work must be public, transparent, democratic, objective, fair, and fair. The Prime Minister proposed the Ministry of Transport to promote the application of the form of examination for the leadership and management positions. In terms of State management, Prime Minister Pham Minh Chinh stated clearly that there must be a strategy and an action plan that concretizes the Resolution of the XIII Party Congress and attaches great importance to the planning work. The national sector plans for the period 2021-2030, with a vision to 2050 that the ministry is building, must be closely connected to form an overall national transport network. From the planning, it is necessary to identify key and key projects to focus resources for implementation. Prime Minister emphasized that, with good planning, good projects, there will be good investors. Along with that, the Ministry of Transport should boldly decentralize, decentralize, assign the locality to be the competent State agency for the project in its area and once again, the Prime Minister reiterates the personalization of responsibility. individuals and strengthen inspection and supervision to promote the initiative and creativity of each agency, unit and locality. It is necessary to do better and more effectively the work of institutional building, focus on solving problems, considering this as one of the key tasks of the Ministry. Prioritize any field, there must be mechanisms and policies for that field to attract investors. If we say priority without policy mechanism, it will not be possible. Regarding the issue of mobilizing resources, the Prime Minister emphasized that the State’s resources are limited, but the Ministry still faces many difficulties, so it is necessary to promote self-reliance, resilience, innovation and creativity. Promote public-private cooperation and a number of other forms of investment, referring to effective models from advanced countries, especially from localities in the country that have done effectively. “The more difficult, more complex and sensitive the job is, the more it is necessary to maintain principles, promote democracy, mobilize collective intelligence, be humble, listen to and decide by majority. What is ripe, clear, proven to be right in practice, is implemented effectively, most of them agree, so do it. If something has not been regulated or in reality beyond the regulations, it should be bravely piloted, done, learned from experience, gradually expanded, not perfectionist and not in a hurry ”, emphasized the Prime Minister. Receiving comments from the Prime Minister, Minister of Transport Nguyen Van The affirmed that the spirit of self-reliance, self-reliance, innovation and creativity will be promoted; promote public-private cooperation. The Ministry will organize seminars to discuss solutions for each issue, each field, and successfully complete the assigned tasks. According to the report of the Ministry of Transport, the Ministry has developed 5 branch plans for the period 2021-2030, with a vision to 2050, including road network planning; rail; master plan for seaport system development; airport and airport planning; Inland waterway infrastructure planning; is expected to be submitted to the Prime Minister according to the plan in the second quarter of 2021. In 2021, will focus all resources to accelerate the construction of important traffic projects: North-South expressway project in the East (11 projects with 654 km), Ben Luc expressway- Long Thanh, My Thuan-Can Tho Expressway, Long Thanh International Airport. Complete the investment in upgrading runways, taxiways of Tan Son Nhat, Noi Bai international airports … At the same time, the Ministry will continue to handle problems and shortcomings at toll stations for using roads. Quickly, synchronously and effectively deploy the non-stop electronic road toll collection system. Perform tasks and solutions synchronously to ensure traffic safety.

Vietnam railway is very outdated and degraded … but up to now, it is still in a state of ‘head go, stay leg’.

According to Mr. Vu Anh Minh, Chairman of Vietnam Railway Corporation (VNR), when transferring to the State Capital Management Committee at enterprises, the industry is still tasked with operating and exploiting the entire structural system. railway infrastructure. But the railway infrastructure is under the management of the Ministry of Transport, which leads to a situation of “head going, feet remaining”. Use maintenance money According to previous regulations, at the beginning of the year, the Ministry of Transport carried out the assignment of the budget capital estimates to the VNR. After that, the unit will place an order for public services with 20 affiliated companies to perform the railway maintenance. On December 31st, the company organized to take over and check assets to continue the maintenance cycle of next year. From 2019, VNR transferred to the State Capital Management Committee at Enterprises, no longer under the Ministry of Transport, so this ministry did not continue to assign capital to non-industry units. Therefore, in 2020, VNR once called for help because it was not assigned capital. Then, based on the resolution of the Government, the Ministry of Transport temporarily assigns capital to VNR to carry out the maintenance. However, by 2021, the plan to assign VND 2,800 billion to any maintenance unit has not been removed. The reason is that the project on management, use and exploitation of national railway infrastructure assets made by the Ministry of Transport has not been approved after many submission to the Prime Minister because of differences in opinion. Specifically, the Ministry of Justice believes that the fact that the Ministry of Transport assigns the maintenance cost estimates to the VNR for implementation is not contrary to the current law. At the same time, there is no need to go through unnecessary intermediaries, slow down the progress of the mission, directly affect the safety of the train. “If assigned to the Railway Bureau, there will be many problems such as inconsistent with the Law on Railways …” – The Ministry of Justice stated. Meanwhile, the Ministry of Finance believes that the assignment of budget estimates for railway management and maintenance to VNR is not in accordance with the provisions of the State Budget Law in Clause 1, Article 49. On this basis, the Ministry of Transport proposed the Government to hand over money for railway maintenance to the Railway Administration, and then return it to the VNR according to the comments of the Ministry of Finance. However, VNR does not agree with this plan. The profit that VNR has will be paid to the budget and annually the budget will allocate about 2,800 billion VND for railway system maintenance. Photo: V.LONG According to which law is reasonable? According to Mr. Vu Anh Minh, currently all railways in countries around the world, the ownership, management, maintenance, and operation of national railway infrastructure assets invested by the State are allotted to businesses. state industry implementation. State-owned enterprises directly manage, maintain, trade in properties and operate. State management agencies do not directly manage, exploit and trade assets, but only properly perform state management functions such as policy making, planning, inspection, and inspection of the implementation of management. property management, exploitation and trading … Currently, VNR is managing 3,143 km of railways passing through 34 provinces and cities. In order to maintain this entire infrastructure, the VNR must organize an asset management system from the parent company level to the member units and the majority shareholding companies. Currently, the industry has 11,315 employees. In which, 1,241 labors of bridge week, road patrol, tunnel week; 915 workers indirectly perform the task of planning and cost estimating the maintenance of the works …; 6,278 maintenance work and quality management of maintenance work; 2,881 employees on duty guarding the crossroads to ensure train operation safety. Therefore, the proposal of the Ministry of Transport will break the consistency between the management and maintenance activities of railway infrastructure with the safety of train operation and railway transport business, delaying the operation. to mobilize railway transport, to eliminate railway transport. “Because then VNR will have to operate railway transportation in the condition that the national infrastructure system is divided, lack of synchronous coordination due to too many entities to manage and operate. This will break the principle of “unification, concentration” – the most basic and key principle in railway transport activities of the railway ever since … “- Mr. Minh said. Meanwhile, Mr. Le Hoang Minh, Director of the Department of Transport Infrastructure (Ministry of Transport), said that the Ministry of Transport’s implementation of the budget for the maintenance of the national railway system to the Railway Administration is is implementing in accordance with the current provisions of the State Budget Law 2020. “The Ministry of Transport must base on the current regulations, can not arbitrarily do any problems without grounds” – Mr. Le Hoang Minh emphasized. The fact that the units leading the Railway Law 2017 stipulate a number of powers for the VNR, including the authority to manage and maintain the national railway infrastructure, Mr. Minh affirmed the budget and financial issues. The main law is to comply with the State Budget Law (general law), while the 2017 Railway Law is a specialized law. However, according to an expert, it is necessary to apply the law in a flexible way, to completely solve this problem, how to create the most favorable conditions for railway maintenance, to avoid people thinking that there is Money is scrambled. “With the package of railway infrastructure maintenance, I think that it is reasonable to assign it to the VNR, if it is assigned to the Railway Bureau through many unnecessary intermediaries, there may be a mechanism for asking – giving …” or. • Invite 20 units but can not sign the contract yet According to the report of the Vietnam Railway Administration, after being assigned with the plan and estimate by the Ministry of Transport, in January 2021, the department drafted a contract to order railway infrastructure maintenance. The Department has invited 20 maintenance units to negotiate and sign orders for orders, but so far the units do not sign contracts. The reason is that VNR, which currently accounts for more than 50% of equity in these companies, does not agree to the member units to sign contracts with the Railway Administration. This is the reason why the contract negotiation has been delayed. “Therefore, the information that the Ministry of Transport and the Vietnam Railway Administration do not assign budget estimates to the VNR and its member units is not the correct nature” – Mr. Le Hoang Minh informed.

The best preparation of the conditions to start the North-South expressway sections through the Central has completed the site clearance and agreed on the route plan which is determined by the localities to implement.

Khanh Hoa prepares building materials

Mr. Nguyen Van Dan, Director of the Department of Transport – Transport (MOT) of Khanh Hoa province, said that this Department, together with the Department of Natural Resources and Environment and the districts and towns with the highway passing through, are urgently reviewing. , report and propose licensing of material mines for construction as soon as the North – South expressway section passes Khanh Hoa expected in the second quarter of 2021.

According to calculations, the North – South expressway project Nha Trang – Cam Lam section needs more than 3 million cubic meters of land for leveling; the section of Cam Lam – Vinh Hao, requires 200,000 m3 of soil for embankment. In addition, the project also needs a large amount of stone for the production of hot asphalt concrete on the road surface. With such a great demand, the project investors are worried about the source of materials during the construction process.

To proactively source materials, from March 2020, the Project Management Board of Ho Chi Minh Road sent a document to the People’s Committee of Khanh Hoa province on the agreement on a material mine, landfill site. According to Mr. Nguyen Van Dan, raw materials for the construction of the North-South expressway through Khanh Hoa are relatively abundant. “The People’s Committee of Khanh Hoa province has approved the quarries, sand for common building materials and land mines for landfilling, which have been issued with a valid mineral mining license by the PPC. has been approved by the Provincial People’s Committee, requesting the Project Management Board of Ho Chi Minh Road to update the above mineral mines to implement the regulations “, Mr. Dan said.

As for the earth, stone, and sand mines used to serve the project without environmental records, the mine owners must make an environmental impact assessment report and submit it to the Provincial People’s Committee for appraisal and approval; the quarry areas, sand as common building materials and land mines used for leveling have not been licensed for exploitation, assign the Department of Natural Resources and Environment to coordinate with relevant units to review and consult to report to the Provincial People’s Committee for handling and settlement.

According to Mr. Le Thanh Binh, Deputy Director of the Ho Chi Minh Road Project Management Board (Ministry of Transport), up to this point, the North-South Expressway Project through Khanh Hoa province has basically completed the liberation. ground; Only a few jobs related to the relocation of technical infrastructure are still being carried out.

Recently, in the meeting with the leaders of Khanh Hoa Provincial People’s Committee, Mr. Le Anh Tuan, Deputy Minister of Transport, also proposed Khanh Hoa Provincial People’s Committee to create material sources, stabilize material prices during implementation, avoid cases. resources are scarce, prices are pushed up.

Binh Dinh and Quang Ngai have agreed the route plan

While the North-South expressway through Khanh Hoa was about to be started, Quang Ngai and Binh Dinh have completed the route plan.

Mr. Nguyen Phong, Director of Quang Ngai Department of Transport, said that the locality has completed the planning of the route and is agreed by the Ministry of Transport, including the starting point at km130 + 800 expressways of Da Nang – Quang Ngai, in Nghia Dien commune (district Tu Nghia, Quang Ngai province) and the end point intersects Provincial Highway 629, in Bong Son town (Hoai Nhon, Binh Dinh).

On the Binh Dinh province side, Mr. Nguyen Tu Cong Hoang, Vice Chairman of the Provincial People’s Committee said that the North-South expressway project through Binh Dinh province was agreed by the Ministry of Transport to be divided into 3 component projects, including: Quang Ngai – Hoai Nhon Project, Hoai Nhon – Quy Nhon Project and Quy Nhon – Tuy Hoa Project (Phu Yen Province).

“There are two directions presented to the leaders of the province and the Ministry of Transport. In which, option 1 builds a route to the east (about 3-4 km from National Highway 1), 110 km long and option 2 builds a western direction (about 12-35 km from National Highway 1) 113 km long. “, Mr. Hoang said.

Through analysis, the two investment plans have their own advantages and disadvantages. However, if done according to option 1, the distance between the expressway to economic zones, industrial clusters and city center. Quy Nhon will be closer, convenient to connect traffic, promote the development of industries in many fields, create a driving force for socio-economic development.

“Option 1 is in line with the planning and development orientation of Binh Dinh to 2035, with a vision to 2050. Therefore, Binh Dinh chooses the plan to build the North-South expressway across the area according to the direction of the Eastern route “, Mr. Hoang emphasized.

According to Deputy Minister of Transport Le Anh Tuan, the fact that Quang Ngai has agreed on the route is an important premise for the project to continue the implementation steps. As for Binh Dinh, the Ministry of Transport has asked the province to continue to work closely with the consultant and the Ministry of Transport to survey the entire North-South expressway through the area, at the same time providing more data related to the locality. project selected by the province.

The Ministry of Transport affirms that the assignment of the budget for the maintenance of the national railway system to the Vietnam Railway Administration is in compliance with the provisions of the Law on State Budget 2020.

The Ministry of Transport confirmed that the allocation of budget estimates for the maintenance of the national railway system to the Vietnam Railway Administration is in compliance with the provisions of the State Budget Law 2020. Photo: VNA

Regarding the document No. 803 / BC-ĐS of the Vietnam Railway Corporation (VNR), make an urgent petition to the Prime Minister about problems in the management and maintenance of national railway infrastructure; In which, VNR emphasized that the difficulty of funding maintenance of railway infrastructure makes it difficult for the railway industry to stand by the end of April 2021, talking to the Vietnam News Agency on the morning of April 16, Mr. Le Hoang Minh, Director of the Department of Transport Infrastructure affirmed that the Ministry of Transport assigning the budget estimate for the maintenance of the national railway system to the Vietnam Railway Administration is in compliance with regulations. the current Law on State Budget 2020.

Specifically, Mr. Le Hoang Minh said that the Ministry of Transport cannot arbitrarily do any problems if it does not base on the current law provisions. The Ministry of Transport does not have to voluntarily assign it to the Vietnam Railway Administration because in the past (before 2018) when the Vietnam Railways Corporation was under the Ministry of Transport, according to the Law on State Budget, It is normal for the Ministry of Transport to assign the maintenance capital of VNR.

“However, when the State Budget Law 2020 came into existence to replace the old State Budget Law, and at the same time VNR moved to be under the State Capital Management Committee in Enterprises, the Ministry of Transport was only assigned capital to affiliated units. On the other hand, state budget capital is only allocated to specialized management units that the railway sector is assigned to the Vietnam Railway Administration ”, said Mr. Le Hoang Minh.

The Director of the Department of Transport Infrastructure affirmed that the Ministry of Transport is implementing the basis of Clause 5, Article 9; Clause 8 of Article 44 and Clause 1 of Article 49 of the 2020 Law on State Budget to allocate capital to the Vietnam Railway Administration. The Vietnam Railway Administration will then sign a contract to order the maintenance of the national railway infrastructure system with the maintenance units of VNR.

Mr. Le Minh Hoang added that in 2020, the above problem was also encountered when the Ministry of Transport could not hand over maintenance capital to VNR, so the Ministry of Transport and Vietnam Railway Corporation must have a written document. a report to the Government, then to the National Assembly resolutions on this issue; including the content of the Ministry of Transport assigning budget estimates to VNR as 2019 and earlier. In implementing the resolution of the National Assembly, the Government also issued Resolution No. 41 / NQ-CP dated April 9, 2020; including the implementation of the Resolution of the National Assembly. After this resolution, the Ministry of Transport has just assigned the 2020 budget estimate for national railway infrastructure maintenance to the VNR.

“Thus, the key is that if it wants to assign a budget that is different from the current State Budget Law, the agency that promulgates the law must issue a resolution on that matter and the Government must issue a resolution. decided to guide the implementation of the contents of the National Assembly’s resolutions ”, Mr. Le Hoang Minh emphasized.

Regarding the content of maintenance companies that are facing difficulties because they do not have maintenance funds, they have to borrow money from banks to pay workers’ salaries, Mr. Le Hoang Minh once again affirmed that the Ministry of Transport attended The budget estimate for the maintenance of the national railway structure system for the Vietnam Railway Administration is in accordance with the Law on State Budget and if the allocation of this budget estimate to the Vietnam Railway Corporation is inconsistent with the regulations. of the State Budget Law.

Returning to the story of the difficulties that 20 maintenance units of Vietnam Railway Corporation are facing, Mr. Le Hoang Minh said that before December 31, 2020, the Ministry of Transport issued a plan. general maintenance for the whole industry; including the railway industry. At the same time, at this time, the Ministry of Transport has also assigned a budget estimate to the Vietnam Railway Administration.

To implement this estimate, the Vietnam Railway Administration has invited 20 railway maintenance units to negotiate and sign an order contract, but so far these units do not sign a contract with the Vietnam Railway Administration. Male. The important reason that these 20 units cannot sign order contracts with the Vietnam Railway Administration is because the Vietnam Railways Corporation currently accounts for more than 50% of the equity in these companies. a member unit signing a contract with the Vietnam Railway Administration. This is the reason why the contract negotiation has been delayed up to this point.

“Thus, the information that the Ministry of Transport and the Vietnam Railway Administration do not assign the budget estimates to the VNR and its member units is not the correct nature. Currently budget estimates and maintenance plans have been built, funding for the maintenance of national railway infrastructure in 2021 is also under the management of the Ministry of Transport, which means money is ready to transport any. When is the time?

Sharing more, Mr. Le Minh Hoang said that the VNR gave the reason that the 2017 Railway Law stipulates a number of powers for the Vietnam Railway Corporation; including the authority to manage the maintenance of national railway infrastructure. However, it must be confirmed that before November 2018, when the VNR was still under the Ministry of Transport. However, when the VNR is no longer under the Ministry but transferred to the State Capital Management Committee in enterprises, and at the same time the State Budget Law in 2020 comes into being, then the new law must be complied with. Although the 2017 Railway Law is still in effect, the budget and financial matters must comply with the State Budget Law (general law) and the Railway Law 2017 is a specialized law.

Before December 31, 2020, the Ministry of Transport issued a general maintenance plan for the whole industry; including the railway industry. Photo: VNA

Previously, Vietnam Railway Corporation issued document No. 803 / BC-ĐS on April 12, 2021, making an urgent petition to the Prime Minister regarding problems in the management and maintenance of infrastructure. national railway.

According to the above document, VNR said that 3,143 km of railway nationwide are currently assigned to the Vietnam Railway Corporation to directly organize the operation, the collected funds are deducted from the state budget 20%, 80 The remaining% is the Corporation’s revenue which is used to spend on operations for the exploitation organization (labor costs, asset maintenance and maintenance …). The maintenance of railway infrastructure assets must always be associated with train operation because the plan for maintenance and maintenance of railway infrastructure assets depends on the train run chart (both running train and exam. railway infrastructure maintenance).

Document No. 803 / BC-ĐS of VNR also said that the project on management and use of national railway infrastructure assets, submitted by the Ministry of Transport to the Prime Minister up to now, still created a lot. intermediate management level, many administrative procedures in the management, maintenance and exploitation of assets. Especially, to increase licensing and approving subprojects (sub-permits) when proposing a mechanism for assigning maintenance cost estimates to the Vietnam Railway Administration. Because VNR said that the Vietnam Railway Administration is currently only performing the function of advising the Ministry of Transport, not managing the railway infrastructure, if the capital is allocated to this unit before allocating it to the VNR, it will slow down. Late maintenance, congestion.

Representative of the Vietnam Railway Corporation said that according to the annual estimate, the budget capital for railway maintenance is VND 2,800 billion, but so far it has not been assigned. Currently, 20 railway maintenance companies under the Vietnam National Railways Corporation, which are responsible for the maintenance of railway infrastructure systems, owe wages to workers for many months, and have not yet had funds to buy maintenance materials. maintenance …

This is not the first time that Vietnam Railway Corporation has called for help because of the slow allocation of maintenance capital. Before that, in early 2020, the railway industry also had to face the same situation when by the end of February 2020, the Ministry of Transport had not yet been assigned funding for railway maintenance. Then, to resolve this situation, the Ministry of Transport had to temporarily hand over the capital to the Railway Corporation after the Resolution of the National Assembly and the Government to place public service orders with 20 companies. under VNR to promptly ensure the safety of train operation such as maintenance, maintenance, patrol, guarding, signal information system … However, by 2021, the plan to allocate capital to any unit has not been remove.

According to the Vietnam Railway Corporation, the industry currently has 11,315 employees. In which, there are 1,241 workers in bridge week, road patrol, tunnel week; 915 workers indirectly perform the task of planning and cost estimating the maintenance of the works …; 6,278 maintenance work and quality management of maintenance work; 2,881 workers on duty guarding the crossroads to ensure the safety of the train./.

The Chairman of the Board of Members of Vietnam Railway Corporation (VNR) had to send an urgent petition to the Prime Minister about problems related to funding for the maintenance of national railway infrastructure, seriously affecting the life of nearly 25,000 workers

Mr. Vu Anh Minh, Chairman of the Board of Members Railway Corporation Vietnam (VNR) has just issued an urgent petition to the Prime Minister “calling for help” on issues related to the development of a National Project on management, use and exploitation of railway infrastructure assets. The State invests and the allocation of resources for management and maintenance of real estate assets.

From 1955 to now, VNR is the only 100% state-owned enterprise established by the State with the purpose of assigning the management, exploitation, use and direct trading of all railway infrastructure assets. (KCHTĐS) in the form of excluding capital components in the enterprise.

VNR leaders said that with 3,143 km of railways going through 34 provinces and cities, in the absence of funding for the management of real estate assets, VNR has organized an asset management system from the General level. companies to member units and joint stock companies with dominant capital contribution.

Up to this point, due to the long and unusual effects of the Covid-19 epidemic as well as the construction of an investment package of VND7,000 billion belonging to medium-term capital, in single track conditions, both train and construction. , The railway industry is in a very difficult period.

Along with that, according to Mr. Vu Anh Minh, problems with funding for the maintenance of national real estate infrastructure in 2021 have not been resolved according to the direction of the Prime Minister, 20 companies perform the task of system maintenance. The national real estate infrastructure currently does not have the budget to buy materials to put into the project, regular expenses and especially to pay employees in the first 4 months of 2021, seriously affecting the lives of nearly 25,000 workers in the VNR. .

“The high risk is that 11,315 workers on the road patrol, bridge week, tunnel patrol, guarding the crossroads … will quit their jobs because they have no income. This issue has pushed businesses to the end, difficult to sustain. until the end of April 2021 “- President of VNR stated in the petition.

According to VNR, the project on management and use of national railway infrastructure assets submitted by the Ministry of Transport (MOT) to the Prime Minister up to this point continues to create many levels of management intermediaries, many administrative procedures. in the management, maintenance and exploitation of real estate assets, increasing licensing, and approving the subproject (sub-license). In particular, it is still proposed a mechanism to assign cost estimates for maintenance to the Vietnam Railway Administration (the agency only performs the advisory function under the Ministry of Transport and does not manage the assets of the real estate infrastructure).

“The proposal of the Ministry of Transport in the Project not only fails to overcome difficulties and problems in production and business activities, but also causes a lot of stagnation and congestion for VNR, pushing businesses to the risk of bankruptcy. , the risk of eliminating railway transport in the transportation system “- VNR leader said.

According to the VNR leader, in order to manage and maintain the assets of the national real estate infrastructure, VNR must organize a comprehensive and coherent human resources system from the parent company to the base units along the railway lines with a total of 11,315 employees were employed, including: 1,241 workers in bridge, road, and tunnel patrol; 915 indirect workers; 6,278 workers perform maintenance and quality control of maintenance work and 2,881 workers guarding the crossroads to ensure safe train operation.

Meanwhile, at present, the organizational apparatus of the Vietnam Railways Administration has only over 100 staff members (most of them are officers of the railway office and the railway traffic safety inspection force), so if the plan is implemented according to the Project, the Ministry As proposed by transportation, VNR still has to fully allocate the above 11,315 human resources to perform the tasks of asset management and the maintenance of national railway infrastructure assets.

“VNR will become an intermediary agency to delay, cause congestion in the process of maintenance and operation of transportation, directly affecting train safety” – VNR leader explained.

Based on the provisions of relevant laws, international experience and especially the practice of managing and operating operations, VNR believes that the Prime Minister and Deputy Prime Minister have chaired meetings with Ministries many times. , departments to analyze the legal basis and have the conclusions and announcements. The Ministry of Justice also appraised the legality in Document No. 193 / BTP-PLDSKT dated January 22, 2021, which confirmed that the delivery of KCHTDS assets and cost estimate for maintenance to VNR Corporation is correct. current laws (including the State Budget Law).

From the above explanations, the Chairman of the Board of Members of VNR sincerely proposes to the Government, the Prime Minister to: Direct the Ministry of Transport to seriously, fully implement the direction of the Prime Minister in the document. 1956 / VPCP-CN dated March 24, 2021 on the management, use and exploitation of national real estate assets.

VNR also proposed to the Prime Minister to direct the Ministry of Transport to continue to assign estimates of economic causes for the management and maintenance of national real estate assets for the period from 2021 onwards to VNR as in previous years.

On April 14, 2021, the supervisory delegation of the Economic Committee of the National Assembly had a meeting with Binh Thuan province on the implementation situation and difficulties and problems in the implementation and implementation of the North Expressway Project – South East, the section across the province.
Based on the proposals of the Thang Long Project Management Board and PMU 7, the Provincial Working Group is now speeding up the determination of the mines being exploited that need to increase capacity, expand the scale, or push To speed up the mining licensing procedures to guide the Miners in order procedures, shorten the time but ensure compliance with the provisions of law.
