Project of Dovillas Villa Village in Tan Thien ward, Dong Xoai city (Binh Phuoc province), has a construction policy since 2016 by Thanh Vinh Production-Trading-Service Co., Ltd. (Thanh Vinh Company) as an investor. . Up to now, the project has not been integrated into land plots, but the investor still buys and sells, many individuals who invest billions of money to invest in the project are crying because the villa is not handed over on time.

Selling villas without changing land use purpose

On December 2, 2016, Binh Phuoc Provincial People’s Committee issued Decision 3129 / QD-UBND approving Thanh Vinh Company to invest in Tan Thien residential project (also known as Dovillas Villa Village) with an area of ​​28,000m2, including 7 land plots of the household of Mr. Vo Thanh Vinh (Director of Thanh Vinh Company). Next, on April 28, 2017, Binh Phuoc Provincial People’s Committee issued Decision 1041 / QD-UBND approving the detailed construction planning project of 1/500 scale for more than 26,000 square meters of the project.

On May 30, 2018, the Department of Planning and Investment of Binh Phuoc Province issued a decision 905 / QD-SKHD to extend construction investment progress. Accordingly, from July 2016 to October 2018, the project must change the purpose of using agricultural land to residential land about 4,500 square meters, and build infrastructure; May 8-2019, completed the change of land use purpose of about 4.956m2 and from September 2016 come into operation.

Present at the Dovillas villa area in early April, we were quite surprised about the progress of the project “cow turtle”. The road to the villa village and some land plots were sold to other people by the investor, the new land owner fenced off and lost the path so he had to enter from the back gate. On the left side is a series of land plots, but only 2 completed villas have been sold to customers; other ground lots, new with foundations and pillars fenced with barbed wire. There is a quite large villa in the middle which is being completed but due to lack of capital, construction has been stopped. The swimming pool is dry, the water pipes are sprawled, the grass is overgrown in many areas, the project’s items are “stationary”.

According to an investigation by PV Newspaper SGGP, although the project has not completed the legal basis such as land and land consolidation, has not fulfilled the financial obligations on land use rights as prescribed, but Thanh Vinh Company has sold. for many people.

Specifically, on June 26, 2018, Mr. Vo Thanh Vinh sold to Mr. NXV (SN 1995, living in Binh Thanh district, HCMC) 15 Tai Loc villas. Mr. Vinh received 26 billion VND and committed on December 26, 2018 to hand over. After that, Mr. V. discovered that Mr. Vinh did not go to the land of the purchased land and did not hand over the villa as committed.

Mr. V. said: “Mr. Vinh tricked me to buy a villa, but did not hand over it. Due to the discovery that Mr. Vinh was cheating, did not go to live and fulfill financial obligations, change the purpose of land use, so I did not continue to pay. The company is no longer able to build projects and fulfill financial obligations regarding land use rights. Mr. Vinh also did not pay me.

Not only that, Mr. Vinh also used the floor of Tai Loc villa (lots No. 28,29,30,31,32) to sell to Mr. V. as a mortgage for Mrs. Đ.TTL 5.2 billion VND on December 16- 2019; bringing 2 land plots of 849.5m2 and 60.4 m2 as a road to transfer to Mrs. NTMN (living in Tan Phu ward, Dong Xoai city). Mrs. N. has fenced off 2 plots of land, so there is no path to the project.

Binh Phuoc Provincial Department of Natural Resources and Environment admitted, Thanh Vinh Company was approved by the People’s Committee of Binh Phuoc province to invest in a residential area project and approved a detailed planning 1/500, but the company has not set up procedures for land allocation. , land lease and change of land use purpose built residential infrastructure projects, transferred to households should have been administratively sanctioned in Decision No. 01 / QD-XPVPHC dated 3-1- 2020.

Deceive many customers

Currently, many customers are “sitting on the fire” for tens of billions of dong to invest in the project, difficult to recover capital. Specifically, in 2017, Ms. NTB (SN 1970, living in Dong Xoai city) was advertised by Mr. Vinh, the Dovillas Villa Village project was legal but did not have enough construction capital and needed advance payment from the buyer. Believe it, Mrs. B. bought 3 villas and handed Mr. Vinh 10 billion dong, but by appointment Mr. Vinh did not hand over the villa as committed. Mrs. B. repeatedly asked for money, but Mr. Vinh used enough reasons to avoid paying debts. Therefore, Ms. B. sued the People’s Court of Dong Xoai City asking Mr. Vinh to pay more than 16 billion VND, including principal and interest, overdue.

Thanh Vinh Company also cannot afford to pay the construction unit. According to the contract, Phan Gia Nguyen Construction-Trading Co., Ltd deployed the construction of the work items in the project, the parties agreed to pay in 4 installments, the amount of more than 15.8 billion VND, but Mr. Vinh only paid 300 million and more than 15.5 billion in debt. On January 7, 2020, Dong Xoai City Civil Judgment Execution Department decided to execute the judgment on this debt, but up to now, Thanh Vinh Company has not yet paid the debt.

Apparently, Thanh Vinh Company took advantage of the investment policy of the Provincial People’s Committee to deceive many customers to buy villas. After receiving the money, the company does not proceed to consolidate the land, settle the land, fulfill financial obligations to the State and hand over the villa as committed. Recently, Binh Phuoc Provincial Department of Planning and Investment has issued official letter No. 562 / SKHĐT-ĐKKD requesting Thanh Vinh Company to implement the contents according to TBKL No. 120 / TB-UBND dated 9-3-2021 of the Provincial People’s Committee.

As a rule, the investment policy of the Dovillas Villa Village project must be withdrawn because of the delay of more than 24 months and the failure to fully comply with the legal, illegal transfer, causing insecurity in the area. However, in order to create conditions for businesses to have time to overcome them, the Department requests Thanh Vinh Company to honestly report on the project implementation process and related civil transactions, to prepare documents to reduce the area. disputed land removed from the project… within 15 days.
